Content Contribution Terms and Conditions – Remmora Platform

By uploading information and content (including but not limited to images, text, video, documents, and audio; hereinafter: "the Content") to this memorial page, you declare that you have read, understood, and agreed to the following binding legal terms. These terms constitute an integral part of the website’s general Terms of Use and Privacy Policy.

1. Contributor Declarations and Legal Standards

  • Ownership and Copyright: You declare and warrant that you are the legal and exclusive owner of the Content, or that you possess express written permission from the rights holders to upload the Content and grant Remmora the rights specified herein.
  • Protection of Minors: It is strictly prohibited to upload content identifying minors (under the age of 18) without the express, prior, written consent of both parents or the minor's legal guardian.
  • Sensitive Content Restrictions:
    • Circumstances of Death: You are strictly prohibited from uploading content that links, directly or indirectly, the deceased to a suicide attempt or act of suicide. This platform is dedicated to respectful commemoration and does not permit content regarding such circumstances.
    • Moral Integrity: You may not upload content attributing criminal offenses or "moral corruption" to the deceased or any third party, or any content constituting defamation.
  • Neutrality, Security, and Politics: It is prohibited to upload content featuring security forces, police, or public figures in uniform in a manner that allows for their personal identification. Additionally, the platform may not be used for political promotion, propaganda, or the use of official decorations for purposes other than private, personal commemoration.

2. Irrevocable Transfer of Control and Finality of Contribution

  • License to Use and Management: By uploading the Content, you grant Remmora and the Admin (the page manager) a permanent (Perpetual), irrevocable (Irrevocable), worldwide, royalty-free, and transferable license to display, store, edit, reproduce, and manage the Content.
  • Waiver of Deletion Rights: You acknowledge that once uploaded, the Content becomes part of a collective memorial record managed by the Admin. You will have no right to request the removal or deletion of the information. The absolute authority to decide whether to retain or remove Content rests solely with the Admin and the Company.
  • Rights of the Deceased: You acknowledge that the privacy rights of the deceased pass to their legal heirs. The Admin, as the representative of the family, holds exclusive legal authority over the page’s content.

3. Prohibited Misuse and Enforcement

  • Prohibited Content: Nudity, sexual content, graphic violence, hate speech, racism, or any degrading and offensive content is strictly forbidden.
  • Harassment: The system must not be used for harassment, stalking, abuse, or any illegal activity.
  • Enforcement: Remmora reserves the right to remove any violating content without notice. In cases of suspected criminal activity or harassment, Remmora will cooperate with law enforcement and may disclose your identifying details (including IP address and email) for legal proceedings.

4. Limitation of Liability and Indemnification

  • No Monitoring: Remmora serves as a technological hosting platform only. The Company does not pre-screen content and bears no responsibility for the accuracy or legality of user-uploaded material.
  • Exclusive Liability: You bear sole responsibility for any infringement of third-party intellectual property, defamation, or invasion of privacy.
  • Indemnification: You agree to indemnify and hold harmless Remmora and its management from any damages, losses, claims, or legal expenses (including attorney fees) resulting from a breach of your declarations or the content you provided.
